Terms of use (interim)
Interim placeholder, pending legal review. Our lawyer is drafting the final Terms of Use. Until they are published, this page sets out the basics in plain words. It is not the final text, and it will be replaced; when it is, the app will ask you to accept the new Terms. Questions: admin@maplebyways.ca.
Who we are
Maple Byways is operated by Kernkraft Consulting Inc., an Ontario corporation ("we"). These terms cover this website and the Maple Byways app.
Routes are suggestions
- Routes are suggestions for trips, written by us. They are not instructions, and they don't replace your own judgment.
- Conditions change. Roads close, businesses shut or change their hours, and seasons and weather change what is safe or open. Every Route shows when we last verified it; things can change after that date.
- Verify before you travel: check roads, opening hours, closures and the weather yourself before and during your trip.
- Maple Byways doesn't navigate or book anything. Directions open in Google Maps, and bookings are between you and the business.
You travel at your own risk
[Placeholder, pending legal review: assumption of risk.] Driving, hiking, swimming and other activities on a Route carry risks. You decide whether to do them and are responsible for your own safety and that of the people with you.
[Placeholder, pending legal review: limitation of liability.] To the extent the law allows, we are not liable for loss, injury or damage arising from following a Route or relying on its information. Nothing in these terms limits rights you have under consumer protection law that cannot be limited.
Accepting these terms
- When you first open the app, it shows a short warning and asks you to tap "I understand".
- When you sign in or first save a Trip, the app asks you to tick a box agreeing to the Terms. We record the terms version, the time and your IP address as proof (see the Privacy notice).
- If we change the Terms in a way that matters, the app asks you to accept them again.
Local picks and content
- Local picks are independent Canadian places to eat and sleep, chosen on merit. Payment never buys a pick.
- Routes, their text and our photos belong to us or are used under licence. Maps use OpenStreetMap data, © OpenStreetMap contributors.
